What is Four Seasons Private Residences, Marrakech?

A 15.7 hectars (38.8 acres) site comprising 20 two- and three-bedroom Ryads (townhouses) and 23 detached three- and four-bed Villas. The Villas and Ryads come with a swimming pool, carport or garage and courtyard water features. The properties shall be built around a 141 room Four Seasons Hotel, including a spa, the facilities and services of which shall be available for Residents' use.

Who are the developers of Four Seasons Private Residences?

The project will be developed by EHC Maroc SA (the "Developer"), a company owned by European Hotels Corporation Limited, Alliances Developpement Immobilier of Morocco and majority shareholder Kingdom Hotel Investments (KHI), who are one of the largest and most diversified hospitality investment companies in the Middle East, Africa and Asia. The development shall subsequently be managed by Four Seasons Hotels and Resorts, founded in 1960 and headquartered in Toronto, Canada. Four Seasons currently has 71 hotels in 31 countries around the world and a further 20 under development. Recognized as the world leader in luxury hotels, Four Seasons has set the standard for luxury hospitality and highly personalised 24hr service.

When will the units be ready?

The construction work of the Private Residences is complete and ready for occupancy.

Are the Villas and Ryads freehold?

Yes

Is there a warranty available on the Villas and Ryads?

Yes, a Decennial warranty of 10 years and a deficiencies warranty of 1 year.

How do I get there from the UK?

Flights depart from both Gatwick and Heathrow regularly with:

What language is spoken in Morocco?

Most Moroccans can speak basic English, with those in the tourist industry having further language skills. English is the third language spoken in Morocco behind French and Arabic. Visitors may find that some basic French or Arabic is useful, but not necessary.

What is the population of Marrakech?

The City of Marrakech has a population of approximately 500,000.

What is the population of Morocco?

Morocco has a population 30 million people.

In what currency are payments required?

Moroccan Dirham.

Do purchasers need to open a Moroccan bank account in order to purchase?

Four Seasons Services

What services and amenities will be available to Residents?

Services will be split into the following three categories, each covered by a separate contract and fee package:

  1. Basic Common Area Services (common areas compulsory to every purchaser)
  2. Hotel Access and Management Services (voluntary)
  3. À la Carte services (voluntary)

NOTE: Residents who do not sign up for the Hotel Access and Management Services will have no access to the Hotel facilities and services, including à la Carte services, and may not participate in the rental Program outlined below.

Do Residents receive reduced rates in the Hotel and Spa?

No. The Management Services allows Residents access to different areas of the Hotel, such as the Spa, Fitness Centre, Pool, Business Centre, Tennis, etc., however, additional charges will apply for services on a pay for usage basis like any other guest of the Hotel.

What are the estimated costs of the various service and amenity packages to Residents?

There will be a separate fee charged to each Resident for each of the following service agreements:

  1. Basic Common Area Services
  2. Hotel Access and Management Services
  3. À la Carte services

The fees for the various service and amenity packages are calculated using a fair and logical allocation of the actual costs for providing these services, plus administrative costs and management fees. In the case where the cost of providing services can be separately identified as being provided to Homeowners only, the actual costs of providing the service will be used to calculate the assessments. In the case where the services provided are shared between the Homeowners and the Hotel, the expense will be allocated based on the value each party receives from the service. Please note that these fees will include proportionately allocated salaries of Hotel staff who will be performing the services.

Will there be a Rental Program?

Yes. Residents will have the option of choosing whether or not to participate in the Four Seasons Rental Program, which is offered through the Hotel.

How will the Rental Program work?

Participating residents will enter into a Rental Agreement and the Private Residences will be marketed by Four Seasons and let out to third party renters.

If participating in the Rental Program, can residents also choose to let their Ryad or Villa directly to friends, family etc?

No, if Residents participate in the Rental Program they cannot rent to family or friends for a fee. However, Residents may allow friends and family to stay at their Ryad or Villa at no cost.

What is the expected rental income for a Resident in the Rental Program?

Rental income cannot be estimated at this time. Rental rates will be determined by the Hotel in its sole discretion and will vary according to the market conditions in place at the time.

Is there a guaranteed rental income in the Rental Program?

No

Can a Private Residence be rented out at any time?

There is the potential for the Private Residence to be rented out at any time. Please refer to the Rental Agreement for specific use and rental guidelines. Each Resident should conduct their own due diligence to understand local market conditions that will impact rental of their Ryad or Villa.

Are any of the management fees and service charges apportioned to hotel expenses?

Yes, as the Private Residences will utilize the Hotel's facilities and services, some of the management fee and service charges will be apportioned to cover the Hotel's expenses.

Do the Villas and Ryads come furnished?

No, but a furniture package will be made available; details of which are currently available. Purchase of the furniture package is mandatory for the participation in the rental program.

Who will manage the common areas of the Villas and Ryads?

The Developer is the designated manager of the Ryads and Villas, who will, in turn, delegate its management of the Private Residences to Four Seasons Hotels and Resorts.

How are Residents' charges and assessments to be paid?

All fees and charges will be paid in any form of payment acceptable to the Hotel.

Can a Villa or Ryad be re-sold at any given time?

Yes, but the Developer reserves the right to first refusal in the event of any re-sales.

What does the Hotel insurance cover in regards to the Private Residences under the Four Seasons Rental Program?

Individual Residents will be responsible for ensuring adequate insurance for their own Ryad or Villa and its contents. Four Seasons will not provide any additional insurance coverage for Private Residences in the Rental Program.


Taxation

What is the rate of tax on income derived from the Hotel rental scheme and how is it deducted?

Income derived from rent is rated at 20% and shall be deducted at source by the Hotel.

Which countries benefit from tax treaties with Morocco?

Morocco has concluded a number of taxation treaties with other countries in order to stimulate foreign investment and avoid double taxation. These countries include:

United Kingdom, United States, France, Germany, Spain, Belgium and Canada.

What is the rate of Capital Gains Tax?
